MacMillan Spirit House closes in Old Town North amid landlord rent dispute

A restaurant and bar with a focus on spirits has closed after nearly two years in Old Town North amid a legal battle with the landlord over rent.

The MacMillan Spirit House is no longer in business at 500 Montgomery Street, the MacMillan Restaurant Group confirmed to ALXnow. The spirit house first opened in late March 2024, as a sister establishment to the MacMillan Whisky Room at the Mosaic District in Fairfax County.

MacMillan Restaurant Group declined to comment on the business’ closure, “as [it] is the subject of active litigation,” it wrote in an email.

According to Fairfax County court records, the property’s landlord terminated the business’ right to possession on Jan. 30, alleging the restaurant owners had failed to pay $237,844 in rent, as of January.

The landlord is seeking nearly $700,000 in rent, unamortized tenant improvement allowance funds and unamortized leasing commission costs, court documents show.

The landlord and their attorney could not immediately be reached for comment. City property records identify the owner of 500 Montgomery Street as “AP 500 Montgomery LLC.”

The property, an office building called Madison Place, currently houses a dentist’s office, veterinarian and nonprofit organization CADCA.
